Apple has already banned the sale of its latest smartwatch models, launched in September, after the ruling found it guilty of infringing another company’s patent.

If one visits the company’s website, they will see that in the advertisement for the Apple Watch Series 9 and Apple Watch Ultra 2, it is written that the specific models are “not available at this time”.

Of course, the ban only applies to Apple’s online or physical stores in the US. Third-party retailers will continue to sell these two models while supplies last.

How did we get to this point?

The ban on the sale of the new smartwatch comes after the US Trade Commission ruled that Apple copied Masimo’s patented technology.

Both retired watches have a feature that monitors the wearer’s blood oxygen levels. After December 24, Apple will not be able to import the Apple Watch from abroad.

How much will the recall cost Apple?

Halting sales of the two latest models could cost Apple between $300 million and $400 million in revenue. Apple says it is currently working on a software update that will fix the problem, according to Bloomberg. At the same time, he has stated that he will try to overturn the initial decision.

For his part, Masismo told Business Insider that the decision “proves that even the most powerful company in the world must abide by the law”. Masimo’s complaint was filed in 2020 and a decision was issued in October 2023. All this time, Apple regularly used the technology in question in its models.

Is Biden Apple’s Only Hope?

“This is not a random breach,” Joe Kiani, CEO and founder of Masimo, told Bloomberg. “This is a deliberate theft of our intellectual property,” he added. Kiani also claimed that Apple contacted and eventually hired 25 of its engineers.

Masimo’s CEO emphasized that he is open to reaching an agreement with Apple. If that doesn’t happen, Apple’s only hope is for President Biden to veto it, which now seems extremely unlikely.
